Terms of Service

These Terms of Service ("Terms") govern your use of Eternal Portrait Studio (the "Service") operated at eternalportraitstudio.com. By creating an account or placing an order, you agree to these Terms.

1. The service

Eternal Portrait Studio creates AI-assisted, human-reviewed memorial portraits combining a photograph of a living person with a photograph of a deceased loved one. We offer digital downloads and printed-and-shipped physical products.

2. Eligibility & your account

You must be at least 18 years old to place an order. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Your content & rights

You confirm that you own or have permission to use every photograph you upload. You grant us a limited licence to use your uploaded photos solely to create, refine and deliver your portrait, and to retain the finished portrait in your account for re-download.

4. Orders & pricing

Prices are shown in the checkout in the currency displayed. By completing payment you authorise us to charge the listed amount, including any applicable taxes and shipping fees for physical products.

5. Revisions

Each order includes one complimentary revisionafter the first preview is delivered. Additional revisions may be available for a small fee, at our discretion. Revisions cover composition, colour and stylistic adjustments — they do not include changing the photographs supplied.

6. Delivery timelines

• Digital proof: delivered within 3–5 business days of payment.
• Digital final: delivered within 24 hours of your approval.
• Printed portraits: shipped within 7–10 days of your approval, worldwide via our print partner.

Delivery estimates are not guarantees. Delays caused by carriers, customs, or incorrect addresses are outside our control.

7. Refunds

All sales are final once AI generation has begun. Full details are in our Refund Policy. In short: cancel before generation starts for a full refund; after generation begins, no refund is offered, though we will work with you on revisions. Damaged prints are replaced at no cost.

8. Acceptable use

You agree not to upload:

• Photographs you do not have the right to use;
• Content involving minors in any inappropriate context;
• Explicit, hateful, or unlawful content;
• Content depicting public figures for harassment or impersonation.

We reserve the right to refuse or cancel orders that violate this section, with a full refund.

9. Intellectual property

On delivery and payment in full, you receive a perpetual, worldwide, personal-use licence to the finished portrait, including the right to print it for your household and share it with family. Commercial resale is not permitted. We retain the right to display anonymised, non-identifying samples of our work for portfolio purposes only with your explicit opt-in.

10. Disclaimers

Portraits are interpretive tribute artworks, not literal photographs. Likeness depends on the quality of the source photographs. The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid for the order in question.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Virginia.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
